1. Privacy Policy (GDPR & CCPA)

Art. 13/14

BrandVisionPartners, registered at 72644 Albstrasse 60 Oberboihingen, Germany, is the data controller for personal data processed through this website and our onboarding wizard. We process identification data (name, company), contact data (email, phone), and project data you voluntarily submit via the dispatch form, email to [email protected], or telephone.

Purposes & legal bases: We process your data to perform pre-contractual measures at your request (Art. 6(1)(b) GDPR), to fulfill contracts and deliver services (Art. 6(1)(b)), to comply with legal obligations including tax retention (Art. 6(1)(c)), and — where you have given separate consent — to send project updates and marketing communications (Art. 6(1)(a)). Our legitimate interest (Art. 6(1)(f)) includes securing the platform, preventing abuse, and improving our funnel.

Recipients & transfers: Data is shared only with processors bound by Art. 28 agreements (hosting, email delivery, payment processing via Stripe) and authorities where law requires. Where data leaves the EEA, we rely on Standard Contractual Clauses or an adequacy decision.

Retention: Inquiry data is retained for up to 24 months after last contact; contractual and invoice data for 10 years per German commercial and tax law (HGB/АО). You may request deletion sooner where no overriding legal duty applies.

Your rights: Under GDPR you have rights of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), portability (Art. 20), and objection (Art. 21). You may withdraw consent anytime without affecting prior processing. You may lodge a complaint with a supervisory authority, e.g. the Landesbeauftragter für den Datenschutz und die Informationsfreiheit Baden-Württemberg.

CCPA / CPRA notice (California residents): We do not sell or share personal information as those terms are defined under the CCPA/CPRA. You may request access to, correction of, or deletion of your personal information, and request information about categories collected and purposes, by emailing [email protected]. We will not discriminate against you for exercising these rights. Authorized agents may submit requests with proof of authorization.

Contact the DPO-equivalent desk: privacy inquiries to [email protected] with subject line “Data Protection”.

2. Terms of Service

B2B Standard

These Terms govern engagements between clients and BrandVisionPartners for digital transformation consulting, web platform development, and marketing services. By dispatching a request through this wizard, paying an invoice, or signing a statement of work, you accept these Terms.

Scope: Each engagement is defined in a statement of work (SOW) listing deliverables, timelines, and fees. In case of conflict, the SOW prevails over these Terms for that engagement. Services outside the SOW require a written change order.

Fees & payment: Prices shown in the configurator are estimates in USD unless stated otherwise. Invoices are due within 14 calendar days unless the SOW states net-30. Late payments may accrue statutory default interest (§ 288 BGB) and may pause delivery. Payment can be completed through our secure Stripe payment link; card and bank details are never stored by BrandVisionPartners.

Client duties: You will provide timely feedback, access, and assets. Delays in client input extend delivery dates day-for-day. You confirm you have rights to all materials you supply.

Intellectual property: Upon full payment, all client-specific deliverables (code, designs, copy produced for you) are assigned to you. BrandVisionPartners retains rights to pre-existing tools, frameworks, and know-how, and may showcase non-confidential work in its portfolio unless you opt out in writing.

Confidentiality: Each party will protect the other’s non-public information with at least reasonable care for three years after disclosure.

Liability: We are liable without limitation for intent and gross negligence, and for damages from injury to life, body, or health. For slight negligence, liability is limited to foreseeable, typical damages at the time of contract. Mandatory product liability remains unaffected. You must notify visible defects within 10 working days of handover.

Termination: Either party may terminate for material breach with 14 days’ written cure period. For ongoing retainers, either party may terminate with 30 days’ notice to the end of a month. Accrued fees for work performed remain due.

Governing law: German law excluding the UN CISG. Place of jurisdiction is Stuttgart, Germany, where the merchant party. Consumer mandatory rights remain intact.

3. Cookie Policy

ePrivacy

BrandVisionPartners uses strictly necessary storage and, subject to consent, optional technologies on this site. You accept non-essential items via the floating toast (“Press Start”); your choice is persisted in your browser’s localStorage under the key bvp_cookie_consent.

Strictly necessary: Session integrity, load balancing, security tokens, and remembering your wizard build (bvp_build) and consent flag. These do not require consent under ePrivacy Directive Art. 5(3).

Analytics (consent): Aggregated, IP-truncated usage metrics that help us improve step completion rates. No cross-site tracking and no sale of data.

Embedded content: Google Maps embeds on the contact page may set cookies when loaded; the map is provided for location reference of 72644 Albstrasse 60 Oberboihingen, Germany.

Managing cookies: You can clear or block cookies in your browser settings at any time. Blocking strictly necessary items may degrade wizard persistence but the site remains usable. For CCPA purposes, cookie data that identifies you personally is treated as personal information; we do not use it to “sell” or “share” as defined by the CPRA.

Updates: Material changes to this Cookie Policy will be dated below. Last revised: September 2026.

4. Refund Policy

Reimbursement

Fixed-scope projects: Deposits (typically 40% at kickoff) are non-refundable once discovery has started, as they reserve delivery capacity. The remaining balance is invoiced against milestones. If you cancel before work begins, we refund any amounts paid minus non-cancellable third-party costs (licenses, stock assets, paid media preloads).

Retainers & subscriptions: Monthly retainers can be cancelled before the next billing cycle with no penalty; the current cycle is non-refundable once begun. Prepaid quarterly retainers are refundable pro-rata for undelivered months if you cancel in the first 14 days of the quarter.

Payment-link purchases: Amounts paid through our Stripe payment link for defined packages are refunded in full if we cannot schedule kickoff within 15 business days of purchase for reasons attributable to BrandVisionPartners.

Non-refundable items: Completed milestones, work already delivered, third-party fees, rush surcharges, and custom research already performed are non-refundable.

How to request: Email [email protected] from the address used at purchase with the subject “Refund Request” and your invoice number. Approved refunds are issued to the original payment method within 14 calendar days. Statutory withdrawal rights for EU consumers (14 days, Directive 2011/83/EU) apply where the law grants them and are not limited by this policy.

Disputes: Contact us first at [email protected] — we resolve the vast majority of billing concerns within two business days. BrandVisionPartners, 72644 Albstrasse 60 Oberboihingen, Germany.
